Being able to do our research and do our investigations and find out what the liability is and who’s at fault – it starts to happen right away. When you start talking about markings on the road – yes, the police officer do what’s necessary and appropriate for them to do their investigations, but oftentimes, we’ll go out and we’ll hire an independent person who’s versed in testifying in front of the court, who’s versed in looking at certain markings on the road and how to make certain determinations or, if it’s a tractor trail involved, trying to get their hands on what you would call, “the little black box,” and all of the information that we can get to, because once those things are erased or they’re gone, they’re lost forever. If you’re talking about an automobile that has a recall on it and you don’t get that automobile and try to check through to see what’s wrong with it or if it falls under that recall, they may scrap that automobile. Then, what do you do? There’s a different process that you have to go through. So I tell folks, “Make sure that you care for your physical needs, but as soon as you know that you’re safe, call an attorney.”

What is the time limit to file a personal injury claim?

The statute of limitations for filing a personal injury for bodily injury is two years in Virginia unless you are a minor. In Virginia, the statute is such that if you are a minor under the age of 18 you have from the time that you had your injury, whatever that age may be until you’re 18 plus two years. So if you are 10 at the time of the accident, you have eight years to become 18, but then you have two years for that statute to run. Even as a minor if you resolve your case by way of settlement, the law in Virginia also has ways of protecting you from the money being squandered or lost. So if I settle a case for a person under the age of 18, what I have to do is set up a hearing and talk to the judge about all of the things that went on into the case, let the judge see if it’s reasonable and appropriate based on the circumstances, and then the judge will order where the money goes. Nine times out of 10, the judge is gonna order that the money be left with the clerk of the court to put wherever the clerk of the court puts that money, and then when that child becomes 18 years old he can come with the proper identifications and then get those proceeds plus whatever interest may have accrued on it. When clients come through the door, their lives have been changed. I try to get them to understand that we’re gonna go through this with them as part of their team. _________________________________________

If you say they offered me a certain amount of money and I don’t know the facts of your case, I don’t know the circumstances, I don’t truly know what your losses are, I can’t tell you whether that’s good, bad or an indifferent number. I can tell you if you bring those facts to us and let us evaluate those facts, we’d be in a better position to tell you whether it’s a good offer based on the circumstances and your facts. What a lot of people want to tell you as well, “My cousin had an accident 15 years ago and they got A, B and C.” I didn’t know what your cousin’s facts were so I can’t tell you that’s good or not. What I need to do is to be able to evaluate your claim, your circumstances. One of the things that people will forget, you may have somewhat of an orthopedic injury without broken bones, but you have pain and discomforts in your system and not even with scaring. Some people want to look at that and say, “Well, you weren’t hurt that bad,” but this is something that you may have to deal with for the next 25 years. You want that lawyer to understand that this is a long-term problem that you’re having. What is that worth to you? The other side to that is, under certain circumstances, we’re aggressive about individuals who may hurt someone but they did it because they were texting, or they were drinking while driving. With those things, a judge or a jury is going to look at you differently when you ask for certain amounts of money based on what you can get in the law. I can’t tell you what to take, but I can tell you if I know the facts, I can put you on the track to get what’s appropriate.
