Can I file for a personal injury on workers comp?
You can only file a personal injury claim if you are injured at work if the injury is caused by a third party, meaning someone that you don’t work with. If the injury is caused by a coworker, then you’re limited to workers’ comp. However, if the injury is caused by someone that you don’t work with, then you can file a claim against that negligent party as well as filing a workers’ comp claim with your employer. It’s our job to identify who you should be pursuing. So if you give us a call, then we will investigate and figure out who the proper party is to pursue or who the proper parties are. If it’s a workers’ comp claim exclusively, then we’ll tell you that. If you have both a workers’ comp claim as well as a personal injury claim, we will tell you that as well.
