You can only file a personal injury claim if you are injured at work if the injury is caused by a third party, meaning someone that you don’t work with. If the injury is caused by a coworker, then you’re limited to workers’ comp. However, if the injury is caused by someone that you don’t work with, then you can file a claim against that negligent party as well as filing a workers’ comp claim with your employer. It’s our job to identify who you should be pursuing. So if you give us a call, then we will investigate and figure out who the proper party is to pursue or who the proper parties are. If it’s a workers’ comp claim exclusively, then we’ll tell you that. If you have both a workers’ comp claim as well as a personal injury claim, we will tell you that as well. The first person that you look to or first entity is the insurance company for the person that caused the accident. But it’s also good to have your own insurance. It’s called uninsured motorist coverage. That’s just in case the person that caused the accident does not have insurance, then you can file a claim with your own insurance company. One of the complex things about an automobile accident is oftentimes there are different types of coverage available for an individual to make a claim against. For instance, there’s the coverage that the driver who caused the accident has, there’s also oftentimes coverage that that person has in his household that maybe responsible for covering his accident, then as the injured party there maybe coverage in your own household, your coverage or a relative’s coverage in the household, and all of these coverages can come together to contribute to pay for the injuries that you’ve sustained I think the main point that I’m probably making here is it’s a very complicated process and one that you have to be familiar with in order to navigate properly. So it’s best to have an attorney and an experienced attorney who can navigate that process for you and with you.

What Type Of Evidence Will Strengthen My Case?

First, we’re going to make an assumption that you understand that you need the basics. That is the lost wages, the medical records, the medical bills. How do you make the case better? First, you get your client ready to testify, to discuss fully what they had to go through. Next, you get your client’s family member who helped them through this accident to tell their story of what they had to do and how they saw the client suffering. Third, you make sure your doctor is ready, able and willing to come in to testify to tell you what he had to go through or she had to go through to get you well.
If you have a serious injury, you can have what’s called a life care plan, that is where you bring in a professional to talk about what you went through right after the accident, but more particularly, what’s going to happen in the future, whether you’re going to be left with some disability, whether you’re going to have to take medicine for the rest of your life, whether you’re going to have to have additional surgeries. They put that together and put a value to that to enhance your case.
We look at your case in two phases. The first is the liability part. If we can prove that the defendant caused the accident, then we move on to the phase that’s called damages, meaning how much they’re going to have to pay. If we go to court, everything is in order so we can prove your case and we can get you the best verdict possible.

How Long Does A Personal Injury Case Take?

Each case is totally different. I can’t give you an exact time frame of how long it will take your case, but I can explain how long it takes based on phases. The first phase is your treatment phase. I don’t know how long it takes you to get well, but that’s the first phase. The second phase is a phase where we gather medical records, medical bills and everything, and sending it to the insurance company for processing. The third phase deals with negotiations. Sometimes that’s short, sometimes that’s long. Negotiations break down, we’re into the trial process.

If you file your case in the general district court, you’ll probably have a hearing in about four or five months. Those cases cannot get any more than $25,000. If you file your case in circuit court, the sky’s the limit, you can ask for any amount you want, it will take between 8 to 10 months to get a verdict. Understand that at any point through this process, your case can settle. There’s still settlement negotiations going on even though the court process is working. If a case settles, the court process is over. The most important part is for the client to treat with his or her doctor and get well. We will take care of everything else.

Your homeowner’s insurance is only going to cover problems within your home but you can get what are called umbrella policies and those policies step in to cover you for injuries that may occur in your automobile, at a local grocery or wherever you might have a personal injury. How much will insurance pay for a personal injury suit?

The insurance companies will only pay to the extent of their policy limits. In Virginia, if you have a policy at all, it’s going to be a minimum of $25,000. If your claim is worth $35,000 and the person who caused the harm to you only has $25,000, the insurance company is only going to pay you $25,000. There may be ways to get additional money through your own coverage if your coverage is more than that or through a family member’s policy that lives in your household if they have a policy that’s more than that or you may be able to pursue that person who caused you harm, individually, if they have additional resources. Most of the time, it’s difficult for our clients to put a value on their case. They’re usually way high or way low. Our firm has been around since 1990 and we’ve done thousands of cases. What is a typical payout for a personal injury claim?

Second point we’re looking at is whether you lost wages and how much. The third point we’re looking at is whether you’re going to be left with any long-term injury.
