How much will insurance pay for a personal injury suit?
The insurance companies will only pay to the extent of their policy limits. In Virginia, if you have a policy at all, it’s going to be a minimum of $25,000. If your claim is worth $35,000 and the person who caused the harm to you only has $25,000, the insurance company is only going to pay you $25,000. There may be ways to get additional money through your own coverage if your coverage is more than that or through a family member’s policy that lives in your household if they have a policy that’s more than that or you may be able to pursue that person who caused you harm, individually, if they have additional resources.
